Operating Rules – Part 2 – Security

Any applicant for membership or member required to provide, post and/or maintain financial security shall enter into a financial security agreement in the form set out by the DRC. The required agreement and bonding policy are maintained in the DRC office and will be made available when security is requested.

DRC PRIVACY RULE – June 29, 2018

The Fruit & Vegetable Dispute Resolution Corporation (DRC) will make public: 1) the names of members in good standing, 2) the names of members who have been suspended, expelled or automatically terminated and the reasons therefore, and 3) the names and titles of the responsibly connected persons of members who have been suspended, expelled or automatically terminated. In addition, the Corporation will make available to other members in good standing the business addresses, business phone numbers and business fax numbers of past and present members and the names of responsibly connected persons to those past and present members as it deems necessary in its sole discretion. E-mail addresses of past and present members will be made available to other members in good standing only if the member specifically authorizes the organization to do so. All information about past and present members, memberships, applications for membership, and responsibly connected persons in relation to those past and present members will be shared with the federal governments of Canada, Mexico and the United States of America. The Canadian Food Inspection Agency (CFIA)is also authorized to share any and all information about applicants or members with respect to the application of CFIA related Acts and Regulations with the DRC. A clause to this effect is to be included in all Membership Application forms.

Operating Rules – Part 4 – Trading Standards

The DRC Trading Standards are general rules of conduct for members to adhere to. They act as default rules when parties cannot agree on the terms of the sale. If members want to create a contract with their vendors that does not conform with the Trading Standards we will refer to that contract during the dispute resolution process rather than the DRC Trading Standards.

Operating Rules – Part 5 – Transportation Standards

The DRC Transportation Standards outline reasonable expectations of all parties when hauling fresh produce. Like the Trading Standards, they act as default rules when parties cannot agree on the terms of the sale. They guide members about claims, transit times and temperatures, multiple pick-ups, partial and pooled loads, and payment terms.

Operating Rules – Part 6 – Dispute Resolution Rules

The Dispute Resolution Rules govern the mediation and arbitration process. They outline step-by-step how to proceed with a claim, including statute of limitations, mediator/arbitrator appointments, submitting evidence, the fee schedule and more.

DRC strives to educate members as to best practices in order to avoid disputes in the first place. The DRC dispute resolution model is designed to reduce risk and facilitate trade between members. DRC, when necessary, provides members with fast, fair and enforceable solutions to disputes arising in the course of member-to-member transactions.
