Nous avons re\u00e7u l\u2019envoi un jeudi soir et le vendredi matin, nous avons communiqu\u00e9 avec l\u2019exp\u00e9diteur pour l\u2019informer que nous demandions une inspection de l\u2019ACIA. L\u2019inspection a \u00e9t\u00e9 effectu\u00e9e le lundi. Le rapport d\u2019inspection a montr\u00e9 que le produit ne rencontrait pas la norme des Directives de la DRC par 1% et que nous avions d\u00e9j\u00e0 vendu une partie des fruits. Apr\u00e8s plusieurs discussions, l\u2019exp\u00e9diteur est dispos\u00e9 \u00e0 ne consentir qu\u2019un tr\u00e8s modeste ajustement du prix. Que la DRC nous conseille-t-elle de faire?<\/p>\n<p><strong>R. Jaime Bustamante:<\/strong> D\u2019abord, vous avez pos\u00e9 les bons gestes en informant l\u2019exp\u00e9diteur et en demandant l\u2019inspection dans un d\u00e9lai appropri\u00e9, proc\u00e9dant ainsi en accord avec les normes commerciales de la DRC. Nous comprenons que vous ne contr\u00f4lez pas le d\u00e9lai avant que l\u2019inspection ne soit effectu\u00e9e et, comme acheteur FAB, ce d\u00e9lai incombe \u00e0 la responsabilit\u00e9 de l\u2019exp\u00e9diteur. Malheureusement, trois \u00e9l\u00e9ments jouent contre vous si vous souhaitez r\u00e9clamer des dommages \u00e0 l\u2019exp\u00e9diteur\u00a0:<\/p>\n<ol>\n<li>Une inspection en temps opportun \u2013 l\u2019inspection a \u00e9t\u00e9 ex\u00e9cut\u00e9e quatre jours apr\u00e8s l\u2019arriv\u00e9e.<\/li>\n<li>Les Directives sur l\u2019arrivage des marchandises de la DRC \u2013 le rapport d\u2019inspection montre que le produit ne rencontre pas la tol\u00e9rance par seulement 1%, ce qui peut laisser croire que s\u2019il avait \u00e9t\u00e9 inspect\u00e9 plus rapidement, le produit aurait peut-\u00eatre rencontr\u00e9 la tol\u00e9rance.<\/li>\n<li>\u00c9chantillon repr\u00e9sentatif \u2013 puisque la portion d\u00e9j\u00e0 \u00e9coul\u00e9e du produit n\u2019a pu faire l\u2019objet de l\u2019inspection, il importe de d\u00e9terminer si l\u2019\u00e9chantillon inspect\u00e9 demeure repr\u00e9sentatif. G\u00e9n\u00e9ralement, on consid\u00e8re qu\u2019un \u00e9chantillon est repr\u00e9sentatif lorsque \u00ab\u00a0plus de 75% de l\u2019envoi est soumis \u00e0 l\u2019inspection.\u00a0\u00bb<\/li>\n<\/ol>\n<p>Il importe de noter qu\u2019en recevant le produit et en en vendant une partie avant de l\u2019inspection, vous avez perdu le droit de le rejeter. Vous pouvez offrir \u00e0 l\u2019exp\u00e9diteur de vous d\u00e9partir du produit mais il n\u2019a aucunement l\u2019obligation d\u2019accepter. D\u00e9charger le produit pour n\u2019importe quelle autre raison qu\u2019une inspection constitue une acceptation de ce produit.<\/p>\n<p>&nbsp;<\/p>\n<p>Nous terminerons enfin en soulignant que, selon notre exp\u00e9rience, un lot qui ne rencontre pas la tol\u00e9rance par 1% quatre jours apr\u00e8s l\u2019arriv\u00e9e, l\u2019aurait presque s\u00fbrement rencontr\u00e9 s\u2019il avait \u00e9t\u00e9 inspect\u00e9 d\u00e8s son arriv\u00e9e.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Q.
