Dans le pr\u00e9sent num\u00e9ro, nous allons examiner la mani\u00e8re par laquelle les Directives sur l\u2019arrivage de marchandises de la DRC (les directives) et les INCOTERMS sont li\u00e9s.<\/p>\n<p>Les directives reprennent les 5 Day FOB Good Delivery Guidelines du PACA et les Lignes directrices en mati\u00e8re de tol\u00e9rances \u00e0 destination et de conditions d\u2019exp\u00e9ditions convenables du Canada, qui fixent le maximum de d\u00e9fauts tol\u00e9r\u00e9s \u00e0 destination pour une transaction FAB au point d\u2019exp\u00e9dition. Elles pr\u00e9sument par d\u00e9faut que le risque est FAB au point d\u2019exp\u00e9dition, sans \u00e9gard \u00e0 la fa\u00e7on dont le transport est pay\u00e9.<\/p>\n<p>L\u2019article 20, Termes en usage dans le commerce, des Normes commerciales de la DRC stipulent que les INCOTERMS comme \u00ab C et F \u00bb, \u00ab C et C \u00bb et \u00ab CAF \u00bb sont tous pr\u00e9sum\u00e9s signifier FAB, sauf que le vendeur assume les diff\u00e9rents co\u00fbts associ\u00e9s \u00e0 chacun; n\u00e9anmoins, le risque du transit demeure avec l\u2019acheteur.<\/p>\n<p>Cons\u00e9quemment, \u00e0 moins qu\u2019il ait \u00e9t\u00e9 convenu d\u2019une norme de cat\u00e9gorie pr\u00e9cise et d\u00e9finie telle US #1, Canada No. 1, or Class I (que l\u2019on conna\u00eet \u00e9galement comme CAT I dans les versions fran\u00e7aise et espagnole du CODEX), toutes les transactions entre les membres de la DRC sont par d\u00e9faut pr\u00e9sum\u00e9es \u00eatre FAB sans sp\u00e9cification de grade.
