Lorsque ces conditions ne peuvent pas \u00eatre remplies, on peut exiger du demandeur d\u2019adh\u00e9sion ou du membre qu\u2019il soumette une garantie financi\u00e8re. Une garantie financi\u00e8re est un montant d\u2019argent d\u00e9tenu par la DRC (pour une p\u00e9riode d\u00e9finie) en guise de promesse de mener ses affaires selon les r\u00e8gles. Si le membre viole une ou plusieurs dispositions du R\u00e8glement ou des r\u00e8gles d\u2019exploitation de la DRC, comme se trouver en d\u00e9faut de verser une sentence arbitrale, par exemple, la DRC pourra utiliser le produit de la garantie financi\u00e8re, selon les dispositions pr\u00e9vues dans l\u2019entente sur la garantie financi\u00e8re en place entre le membre et la DRC.<\/p>\n<p>La DRC peut exiger une garantie financi\u00e8re pour diff\u00e9rentes raisons telles que\u00a0: l\u2019emploi d\u2019un individu qui a d\u00e9j\u00e0 \u00e9t\u00e9 insolvable; \u00eatre nomm\u00e9ment cit\u00e9 dans un ordre du tribunal; avoir \u00e9t\u00e9 radi\u00e9 de la liste des membres de la DRC au cours des cinq derni\u00e8res ann\u00e9es; et ainsi de suite. En outre, un membre qui devrait normalement \u00eatre radi\u00e9 peut parfois \u00e9viter la radiation en d\u00e9posant une garantie financi\u00e8re.<\/p>\n<p>Il y a deux types de garantie financi\u00e8re\u00a0: (i) celle pour le demandeur ou le membre; et (ii) celle pour l\u2019employ\u00e9. Les cautionnements** pour demandeur et membre sont exig\u00e9s lorsque le demandeur ou le membre a commis un acte qui d\u00e9clencherait notre politique sur le cautionnement (par exemple, en d\u00e9posant une proposition \u00e0 ses cr\u00e9anciers o\u00f9 ils ne re\u00e7oivent que quelques sous pour chaque dollar). Dans cet exemple, le montant de la garantie financi\u00e8re serait de 50\u00a0000\u00a0$ mais pourrait \u00eatre plus ou moins \u00e9lev\u00e9 compte tenu de facteurs aggravants ou att\u00e9nuants comme la taille de l\u2019entreprise, l\u2019impact d\u2019une \u00e9ventuelle insolvabilit\u00e9 sur l\u2019ensemble du secteur, le type d\u2019exploitation, les violations ant\u00e9rieures, le motif de l\u2019imposition d\u2019une garantie financi\u00e8re, etc.<\/p>\n<p>On peut \u00e9galement exiger des membres et des demandeurs d\u2019adh\u00e9sion qu\u2019ils d\u00e9posent une garantie financi\u00e8re lorsqu\u2019ils emploient un individu qui ne r\u00e9pond pas aux conditions d\u2019adh\u00e9sion d\u00e9finies dans les r\u00e8gles d\u2019exploitation de la DRC. Contrairement \u00e0 celle d\u2019un membre ou d\u2019un demandeur d\u2019adh\u00e9sion, le cautionnement pour un employ\u00e9 est fix\u00e9 \u00e0 25\u00a0000 ou \u00e0 50\u00a0000\u00a0$, selon la nature de la violation commise par l\u2019individu et son nouveau r\u00f4le au sein de l\u2019entreprise du membre.<\/p>\n<p>Si un membre a d\u00e9pos\u00e9 une garantie financi\u00e8re, peu importe la raison, et qu\u2019il est en d\u00e9faut de payer ses dettes au moment o\u00f9 elles sont \u00e9chues ou qu\u2019il suspend l\u2019exploitation d\u2019une entreprise qui doit de l\u2019argent \u00e0 ses cr\u00e9anciers, la DRC utilisera l\u2019argent de la garantie financi\u00e8re pour payer les autres membres qui auront soumis une preuve de r\u00e9clamation. Un mot d\u2019avertissement cependant, ne consentez pas davantage de cr\u00e9dit en pr\u00e9sumant que, parce qu\u2019une entreprise a d\u00e9pos\u00e9 une garantie financi\u00e8re, vous serez pay\u00e9 de toute mani\u00e8re.
