Cela veut dire conserver une copie de vos notes, de vos courriels et de tout autre document pertinent. Si des arrangements sont conclus par t\u00e9l\u00e9phone, assurez-vous de confirmer les d\u00e9tails de la conversation par \u00e9crit, soit dans un registre d\u2019appel, soit dans votre dossier pour ce fournisseur.<\/p>\n<p>Combien de temps devriez-vous conserver cette documentation? Il y a certains registres et documents qui doivent \u00eatre conserv\u00e9s pour une p\u00e9riode d\u2019au moins deux ans, y compris les factures, les inspections, les billets de vente, les bons de commande et les connaissements.<\/p>\n<p>Pour les autres documents \u00e9crits concernant une transaction, ils devraient \u00eatre conserv\u00e9s jusqu\u2019\u00e0 ce que le dossier soit r\u00e9gl\u00e9 et ferm\u00e9. Dans l\u2019\u00e9ventualit\u00e9 o\u00f9 appara\u00eet un probl\u00e8me qui pourrait aboutir en un diff\u00e9rend, nous vous recommandons de conserver cette documentation au moins neuf mois \u00e0 compter de la date que vous avez eu connaissance de la pr\u00e9sence du probl\u00e8me potentiel, neuf mois \u00e9tant la p\u00e9riode durant laquelle il est possible de soumettre un diff\u00e9rend \u00e0 la DRC.<\/p>\n<p>Les courriels, registres d\u2019appels, notes manuscrites ou autres entr\u00e9es au dossier d\u2019un fournisseur sont tous pertinents lorsque survient un diff\u00e9rend. Tout document montrant qu\u2019un \u00e9l\u00e9ment a \u00e9t\u00e9 discut\u00e9 et convenu peut \u00eatre pr\u00e9sum\u00e9 pertinent durant le processus de r\u00e8glement de ce diff\u00e9rend.<\/p>\n<p>Un bon exemple est de toujours vous assurer de rappeler \u00e0 l\u2019acheteur, et de le documenter par \u00e9crit, que vous vous attendez \u00e0 ce qu\u2019une inspection f\u00e9d\u00e9rale soit men\u00e9e, \u00e0 moins que vous n\u2019ayez convenu ensemble du recours \u00e0 une inspection priv\u00e9e. Toute entente inhabituelle telle que le recours \u00e0 une inspection priv\u00e9e ou des modifications restrictives aux dispositions du contrat comme \u00ab\u00a0FAB Acceptance finale\u00a0\u00bb doit \u00eatre <strong>discut\u00e9e, comprise et convenue (DCC)<\/strong>. DCC est un acronyme dont vous voudrez vous rappeler. La partie qui invoque de telles ententes sp\u00e9ciales a le fardeau de prouver qu\u2019elles ont bel et bien \u00e9t\u00e9 convenues entre les parties lorsque l\u2019autre s\u2019y objecte. Si vous ne connaissez pas toutes les r\u00e8gles, vous pourrez convenir de quelque chose qui limite vos droits. Un arbitre examinera vos notes dans le cours du processus de r\u00e8glement du diff\u00e9rend. Aussi, vos notes devraient-elles clairement d\u00e9montrer quelles dispositions ont \u00e9t\u00e9 discut\u00e9es, comprises et convenues entre l\u2019exp\u00e9diteur et le destinataire.
