{"id":331,"date":"2017-01-16T09:14:36","date_gmt":"2017-01-16T14:14:36","guid":{"rendered":"https:\/\/fvdrc.com\/?page_id=331"},"modified":"2026-03-02T11:37:13","modified_gmt":"2026-03-02T16:37:13","slug":"mediation-informelle","status":"publish","type":"page","link":"https:\/\/fvdrc.com\/fr\/reglement-des-differends\/mediation\/mediation-informelle\/","title":{"rendered":"M\u00e9diation informelle"},"content":{"rendered":"\n<p><strong>Le syst\u00e8me de r\u00e8glement informel des diff\u00e9rends<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La m\u00e9diation informelle constitue le point de d\u00e9part des proc\u00e9dures formelles de la DRC.<\/li>\n\n\n\n<li>Elle impose certaines exigences en mati\u00e8re de soumissions de documents, de m\u00eame qu\u2019un d\u00e9lai de 21 jours pendant lequel les parties tentent ensemble de r\u00e9gler leur diff\u00e9rend.<\/li>\n\n\n\n<li>La m\u00e9diation informelle accorde aux parties une occasion de soumettre un compte-rendu \u00e9crit de ce qui ressort de la transaction, accompagn\u00e9 de la documentation pertinente.<\/li>\n\n\n\n<li>Apr\u00e8s que les deux parties aient eu la chance de soumettre leur contribution respective, le personnel de la DRC les aide \u00e0 tenter d\u2019en venir \u00e0 l\u2019amiable \u00e0 un r\u00e8glement volontaire.<\/li>\n\n\n\n<li>Si les parties ne peuvent convenir d\u2019un r\u00e8glement, elles pourront alors opter pour la m\u00e9diation formelle ou l\u2019arbitrage.<\/li>\n\n\n\n<li>La m\u00e9diation formelle est une option \u00e0 laquelle on peut recourir quel que soit le montant en dollars de la r\u00e9clamation.<\/li>\n\n\n\n<li>Pour recourir \u00e0 cette option, les deux parties doivent y consentir et la m\u00e9diation est men\u00e9e par un m\u00e9diateur ind\u00e9pendant choisi \u00e0 partir de la liste de m\u00e9diateurs que maintient la DRC.<\/li>\n\n\n\n<li>Si les parties ne peuvent convenir du recours \u00e0 la m\u00e9diation formelle, ou si la m\u00e9diation formelle ne r\u00e9ussit \u00e0 produire un r\u00e8glement acceptable aux deux parties, l\u2019une ou l\u2019autre des parties peut alors demander que l\u2019on proc\u00e8de \u00e0 un arbitrage.<\/li>\n\n\n\n<li>\u00c0 la diff\u00e9rence de l\u2019arbitrage, tous les d\u00e9tails d\u2019une m\u00e9diation formelle demeurent confidentiels.
