{"id":5392,"date":"2021-06-28T10:47:17","date_gmt":"2021-06-28T14:47:17","guid":{"rendered":"https:\/\/www.fvdrc.com\/?p=5392"},"modified":"2021-06-28T10:47:18","modified_gmt":"2021-06-28T14:47:18","slug":"seguridad-alimentaria-y-transporte","status":"publish","type":"post","link":"https:\/\/fvdrc.com\/es\/solutions\/seguridad-alimentaria-y-transporte\/","title":{"rendered":"Seguridad alimentaria y transporte"},"content":{"rendered":"\n<p>En julio de 2017 escribimos un art\u00edculo titulado: <a href=\"https:\/\/fvdrc.com\/es\/solutions\/transportation-rejection-due-food-safety-concerns\/\"><strong>\u201cTransporte: Rechazo debido a preocupaciones de inocuidad alimentaria\u201d<\/strong><\/a><strong>.<\/strong><\/p>\n<p>Ese art\u00edculo se centr\u00f3 con un ejemplo espec\u00edfico; se percibi\u00f3 un extra\u00f1o olor cuando las puertas del cami\u00f3n se abrieron al descargar el producto. Sugerimos solicitar una inspecci\u00f3n gubernamental tan pronto como se detecte el olor desagradable en el momento de abrir las puertas y proceder a cerrarlas. Dependiendo de los resultados de la inspecci\u00f3n, es posible \u2013<em>posible\u2013 <\/em>que el receptor sea capaz de rechazar la carga debido a problemas de seguridad alimentaria.\u00a0<\/p>\n<p>En a\u00f1os anteriores, y en particular durante la \u00e9poca de la pandemia de COVID-19, nos hemos encontrado otras situaciones en las que la Seguridad Alimentaria fue una preocupaci\u00f3n luego de que el transportista sufriera un accidente o un problema mec\u00e1nico. En estos casos, la empresa de transporte inform\u00f3 apropiadamente a los receptores de la situaci\u00f3n. La carga parec\u00eda estar en buenas condiciones a su llegada, salvo por algunos pallets desplazados que se volvieron a apilar bien o por el hecho de haber trasladado el producto a un nuevo remolque. No obstante, aparte del retraso en la entrega, los receptores expresaron su preocupaci\u00f3n por la seguridad alimentaria inmediatamente despu\u00e9s de ser informados de la situaci\u00f3n. Se preocuparon por saber qui\u00e9n hab\u00eda manipulado la carga en cuesti\u00f3n y si se hab\u00edan seguido los protocolos de seguridad alimentaria.<\/p>\n<p>El personal de la DRC fue capaz de mediar de manera informal estos casos y de ayudar a las partes a llegar a un acuerdo amistoso. Debido al \u00e9nfasis actual en la seguridad alimentaria y la pandemia, no es dif\u00edcil entender que nadie quiera ser responsable de romper los protocolos de seguridad alimentaria. Esto puede terminar perjudicando al consumidor final y conducir a la posible responsabilidad por cualquier repercusi\u00f3n legal.\u00a0<\/p>\n<p>Quiz\u00e1 haya escuchado al personal de la DRC decir que todas las reclamaciones deben ser probadas y documentadas. Entonces, \u00bfqu\u00e9 significa eso en los casos en los que se han incumplido los protocolos de seguridad alimentaria, pero no existe una prueba real de riesgo para los consumidores?<\/p>\n<p>Un reclamo de esta naturaleza es muy diferente a si el producto cumple o no con la buena llegada, o si las dos partes acordaron cambiar el contrato. Consideramos que la salud p\u00fablica es primordial y que los protocolos de seguridad alimentaria para proteger a los consumidores tendr\u00e1n prioridad. Por lo menos, las acciones que rompen la cadena de custodia e impiden la rastreabilidad del producto podr\u00edan considerarse como incumplimientos materiales del contrato que justifiquen un rechazo. Estamos monitoreando para determinar si esta opini\u00f3n se concreta en la pr\u00e1ctica.\u00a0\u00a0<\/p>\n<p>De momento, hay que seguir los protocolos y mantener a su socio comercial informado de las dificultades.
