{"id":5305,"date":"2021-05-28T09:38:08","date_gmt":"2021-05-28T13:38:08","guid":{"rendered":"https:\/\/www.fvdrc.com\/?p=5305"},"modified":"2021-05-28T09:38:09","modified_gmt":"2021-05-28T13:38:09","slug":"terminos-norteamericanos-o-incoterms","status":"publish","type":"post","link":"https:\/\/fvdrc.com\/es\/solutions\/terminos-norteamericanos-o-incoterms\/","title":{"rendered":"TERMINOS NORTEAMERICANOS O INCOTERMS\u00ae?"},"content":{"rendered":"\n<p>Nuestro Personal de Asistencia Comercial contin\u00faa viendo casos en los que los compradores norteamericanos que importan productos frescos de productores o vendedores extranjeros, tienen dificultades para entender sus responsabilidades bajo los supuestos INCOTERMS\u00ae \u201cacordados\u201d.<\/p>\n<p>Los compradores y vendedores norteamericanos de frutas y hortalizas frescas han adoptado dos t\u00e9rminos comerciales principales para sus transacciones dentro de Am\u00e9rica del Norte: FOB y DELIVERED (FOB Destino), que se utilizan principalmente para el transporte interior. Si bien esto ha funcionado bastante bien en Am\u00e9rica del Norte, hemos observado que cuando se compra productos de Europa, Asia, Sud\u00e1frica, Sudam\u00e9rica u otras partes del mundo, no se discuten o entienden adecuadamente los detalles fundamentales sobre el riesgo, el costo y la liberaci\u00f3n dependiendo de los INCOTERMS\u00ae acordados.<\/p>\n<p>No podemos recalcar lo suficiente la importancia de conocer mejor los INCOTERMS\u00ae dentro de su empresa, tanto en el departamento de compra\/venta como en el departamento de log\u00edstica, si existe.<\/p>\n<p>Un error com\u00fan que sigue pasando por nuestro escritorio es cuando un comprador norteamericano solicita al cultivador\/embarcador extraterritorial que le &#8220;entregue&#8221; el producto en el puerto indicado. El comprador norteamericano asume que el cultivador\/embarcador en el extranjero se encargar\u00e1 de todos los detalles para entregar el producto en el destino indicado, pero se olvida de discutir el riesgo y\/o el despacho de aduanas. Sin discutir estos elementos, el cultivador\/embarcador puede utilizar los INCOTERMS\u00ae CFR o CIF y cumplir con la petici\u00f3n del comprador. Esta falta de comunicaci\u00f3n suele crear una controversia cuando hay que reclamar a la naviera por da\u00f1os y perjuicios o cuando llega el momento de absorber los costos del despacho de aduanas.<\/p>\n<p>En el ejemplo anterior, la empresa norteamericana podr\u00eda haber utilizado un t\u00e9rmino m\u00e1s apropiado como DAP, DPU o DDP, que autom\u00e1ticamente habr\u00eda transferido el riesgo del tr\u00e1nsito al cultivador\/embarcador, adem\u00e1s de establecer la responsabilidad del costo del despacho de aduanas.<\/p>\n<p>Le sugerimos firmemente que los miembros de la DRC consulten el sitio web de la C\u00e1mara Internacional de Comercio y se familiaricen con los <a href=\"https:\/\/iccwbo.org\/resources-for-business\/incoterms-rules\/incoterms-2020\/\">INCOTERMS<\/a>\u00ae.
