Desafortunadamente, en estos casos, el embarcador\/vendedor no se entera del problema hasta que se vence el pago. Cuando el embarcador\/vendedor se contacta con el recibidor\/comprador para solicitar informaci\u00f3n sobre el pago, se entera de que una inspecci\u00f3n del gobierno (realizada de manera oportuna) demuestra que el producto no cumpli\u00f3 con las Directrices de Buena Llegada de la DRC. \u00bfDeber\u00eda el receptor preocuparse por no avisar oportunamente al embarcador de los problemas de calidad?<\/p>\n<p>S\u00ed. Hay un par de circunstancias en las que un recibidor\/comprador deber\u00eda estar muy preocupado por no comunicar los problemas de manera oportuna, incluido el no compartir los resultados de una inspecci\u00f3n gubernamental.<\/p>\n<p>De acuerdo con el precedente de la Ley de Productos Agr\u00edcolas Perecederos (PACA) y las Normas de Comercio de la DRC, para tener un reclamo exitoso, se deben probar tres elementos: (1) que hubo un incumplimiento de contrato por parte del embarcador; (2) que el aviso del incumplimiento del contrato fue entregado al embarcador; y (3) prueba de da\u00f1os.<\/p>\n<p>El n\u00famero dos es el que nos concierne en este art\u00edculo. La DRC y la PACA definen un tiempo razonable como el que no excede las 24 horas en los env\u00edos de tren y barco, y 8 horas en cami\u00f3n. Adem\u00e1s, ambos requieren que se comparta una copia de la inspecci\u00f3n del gobierno dentro de las 24 horas posteriores a que el informe de inspecci\u00f3n est\u00e9 disponible para el solicitante.<\/p>\n<p>Es bastante com\u00fan que un embarcador tenga plazos de pago de 30 d\u00edas, pero su proveedor (otro embarcador o un productor) puede tener plazos de pago de diez (10) d\u00edas. En este caso, si el embarcador procede a pagar al proveedor dentro de los t\u00e9rminos porque no se le notificaron de problemas a la llegada, el receptor puede ser responsable del pago total, incluso si haya tenido una inspecci\u00f3n gubernamental oportuna que demuestre los da\u00f1os.
